On or about March 1, 2012, Respondent practiced podiatry below the standard of care when Respondent performed an inappropriate surgical procedure on a patient who had presented to him with a painful second hammertoe. Respondent removed the top 3mm of articulating cartilage, which was not a surgical plan that would have resolved this patient's condition. Other surgical options were available to Respondent that would have addressed and could have resolved the patient's condition.

On 02/12/09 Respondent performed surgery on a patient, which included: Opening based wedge osteotomies, bilateral bunions; subtalar joint arthrorisis procedure with 8mm BIO-ARCH implant, bilaterally; hammertoe correction with Swanson implants, 2nd and 4th digits, left. The need for the each of these procedures was poorly documented prior to the surgery. Post-operative documentation for the surgery on 02/12/09 was insufficient in that it was extremely minimal and did not meet minimum documentation standards. Following surgery on 02/12/09, the intermetatarsal angles of both feet were more severe than before surge1y. Respondent failed to recognize this and also failed to address the patient's ongoing pain due to the implants.

The application submitted on Applicant's behalf appeared to bear his signature and was notarized by a notary public of Arizona and dated February 25, 2014. The application was received from a staff member of Daniel Bangart, DPM, Arizona license number 0345, and was accompanied by a personal check from Dr. Bangart for the application fee. During the administrative and substantive review periods, suspicion arose as to the authenticity of the application document. Applicant was questioned regarding the notarized date and his signature on the application. Applicant asserted several times that the document was authentic.  In an appearance before the Board on June 11, 2014, Applicant admitted that he had not actually signed the application document in question. Applicant stated that he did not want to miss the application deadline due to a pending employment offer from Dr. Bangart. Applicant also stated that the course of action and deception in submitting the application document was initiated by Dr. Bangart but that he willingly participated in the deception in an effort to obtain a license.

During a lawful course of treatment, Respondent was prescribed a medication for pain relief. During that course of treatment, Respondent began using more than the prescribed daily dosage of the medication. Respondent's spouse also had a prescription for that medication. Respondent admitted diverting some of that medication for her own use. Pursuant to the information obtained from Dr. Loes, MD, Respondent does not currently have any disorder that prevents her from safely practicing podiatry; and her current medications, if taken as prescribed, do not impair her ability to practice safely. Dr. Levin billed three separate codes when there should only have been one billing code for the one procedure.
